Terms of Service

These Terms of Service ("Terms") govern access to and use of the Tour Command Center (TCC) platform operated by AJA SARAH INFORMATION TECHNOLOGY CONSULTANCY ("AJA Sarah Marketer", "AJA Digital Group", "TCC", "we", "us"). By accessing or using TCC, you agree to be legally bound by these Terms.

1. Acceptance (Clickwrap Agreement)

By clicking "Agree", signing in, or using the platform, you acknowledge that you have read, understood, and agreed to these Terms and the Privacy Policy. If you do not agree, you must not use TCC.

2. Platform Nature (Critical)

TCC is a Software-as-a-Service (SaaS) platform that provides digital coordination, automation, and data management tools. We do NOT:

• Organize or operate tours
• Provide transportation, logistics, or field supervision
• Act as a travel agency or tour provider

3. User Roles & Responsibility

Tour Operators / Agencies:

• Full responsibility for tour execution, logistics, permits, and safety
• Accuracy of manifests and uploaded data
• Insurance and compliance with laws

Schools / Institutions:

• Parental consent and documentation
• Student supervision and welfare
• Data accuracy and authorization

4. Data Accuracy

All data entered into TCC is the sole responsibility of the submitting party. TCC acts only as a digital mirror and processing system.

5. Acceptable Use

• No unauthorized access, hacking, scraping, or reverse engineering
• No unlawful, fraudulent, or harmful use
• No uploading of data without proper authority or consent

6. Zero-Trust Security Policy

TCC enforces strict access control. Any attempt to bypass authentication or compromise the system will result in immediate termination and possible legal action.

7. Fees & Access

Access to TCC may be subject to subscription or service agreements. Failure to pay may result in suspension or termination.

8. Intellectual Property

All platform components, systems, workflows, and architecture remain the exclusive property of AJA Digital Group. Users are granted a limited, non-transferable license to use the platform.

9. Limitation of Liability

To the maximum extent permitted by law:

• TCC is NOT liable for any tour-related incidents, injuries, losses, or disputes
• We are NOT responsible for third-party actions
• Our liability is limited to fees paid for the service

10. Indemnification

Users agree to indemnify and hold harmless AJA Digital Group from any claims, damages, or liabilities arising from:

• Use or misuse of the platform
• Tour operations and execution
• Violation of laws or third-party rights

11. Third-Party Services

TCC relies on third-party providers (e.g., Google, Firebase). We are not liable for their performance or policies.

12. Service Availability

We aim for high uptime but do not guarantee uninterrupted service. Maintenance, outages, or force majeure may occur.

13. Termination

We may suspend or terminate access at any time for violations, security risks, or non-payment.

14. Data Processing Role

TCC acts as a Data Processor. Clients (agencies/schools) act as Data Controllers.

15. Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

16. Dispute Resolution

Disputes shall first be resolved amicably. If unresolved, jurisdiction shall be within Philippine courts.

17. Force Majeure

We are not liable for delays or failures due to events beyond our control.
